Withdrawing your consent to data processing

Mailchimp

This website uses the services of Mailchimp to send newsletters. It is provided by Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.

Mailchimp is a service which can organize and analyze the sending of newsletters. If you provide data for the purpose of receiving the newsletter (e.g., your email address), the data is stored on the servers of Mailchimp in the USA.

We use Mailchimp to analyze our newsletter campaigns. When you open an email sent with Mailchimp, a file (i.e. a web beacon) contained in the email connects to the servers of Mailchimp in the USA. This enables us to determine whether or not you have opened a newsletter and what links you have clicked on, if any. Technical information is also collected (e.g., the date and time when you opened the newsletter, your IP address, your browser type, and your operating system). This information cannot be attributed to the recipient of each newsletter. It is only used to perform statistical analyses of newsletter campaigns. The results of these analyses can be used to tailor future newsletters to the interests of their recipients more effectively.

If you object to analysis by Mailchimp, you will have to unsubscribe from the newsletter. Every newsletter we send contains a link that you can click on to unsubscribe. You can also unsubscribe from the newsletter on the website directly.

The data is processed on the basis of your consent (point (a) of Article 6(1) GDPR). You can withdraw this consent at any time by unsubscribing from the newsletter. A withdrawal of consent does not retroactively affect the lawfulness of data processing that has taken place up to the moment of withdrawal. We have entered into a processing agreement with Mailchimp under which Mailchimp is obligated to protect the data of our customers and not to share the data with third parties.

Campaign Monitor

Our website uses the newsletter mailing platform Campaign Monitor. It is provided by Campaign Monitor, Level 38, 201 Elizabeth Street, Sydney, NSW 2000, Australia.

The email addresses of the recipients of our newsletters, as well as the other data belonging to them as described in this privacy policy, are stored on the servers of Campaign Monitor in Australia, the USA, and Germany. Campaign Monitor uses this information to send and evaluate newsletters on our behalf. According to its own information, Campaign Monitor can also use this data to optimize or improve its own services, e.g., to optimize how newsletters are sent and displayed or for economic purposes in order to determine the countries in which the recipients live. However, Campaign Monitor does not use the data of the recipients of our newsletters to contact them itself or share the data with third parties.

 

The data is processed on the basis of your consent (point (a) of Article 6(1) GDPR). You can withdraw this consent at any time by unsubscribing from the newsletter. Mandrill

Our website uses the service Mandrill to send newsletters. It is provided by The Rocket Science Group LLC, 512 Means St. Suite 404, Atlanta, GA 30318, USA. This service enables us to manage a database of email contacts internally. The service manages data relating to when an email that we sent to you was opened or links in the email were clicked on. Technical and organizational security measures are in place to ensure that your personal data is protected against loss and unauthorized modification and that it cannot be accessed by unauthorized third parties. Furthermore, on our part, only authorized persons have access to your personal data and only to the extent necessary for the purposes of the contract.

We use Mandrill on the basis of our interest in having a reliable email database. This is a legitimate interest in the sense of point (f) of Article 6(1) GDPR.

YouTube in privacy-enhanced mode

Our website uses YouTube plugins. The website is operated by Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We operate a Facebook fan page on Facebook, a service provided by Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland.

All conventional payment methods can be processed via the interface of the e-payment platform from Datatrans. Datatrans is provided by Datatrans AG, Kreuzbühlstrasse 26, 8008 Zurich, Switzerland. Datatrans meets the conventional security standards, especially the Payment Card Industry Data Security Standard (PCI DSS). The payment details you enter is encrypted and sent to Datatrans and cannot be accessed by us.

SOFORT Banking

We offer SOFORT Banking as a payment method on our website. This payment service is provided by Sofort GmbH, Theresienhöhe 12, 80339 Munich, Germany (“Sofort GmbH”). When we use SOFORT Banking, Sofort GmbH sends us a payment confirmation in real time so we can start attending to our obligations immediately.

If you choose SOFORT Banking as a payment method, you send the PIN and a valid TAN to Sofort GmbH which it will be able to use to log into your online banking account. After logging in, Sofort GmbH checks your account balance automatically and initiates the transfer to us using the TAN you provided. It then sends us a transaction confirmation immediately. After logging in, it also checks your transactions, your overdraft, the existence of other accounts, and their balances automatically.

The payment details you provide and data concerning your identity are sent to Sofort GmbH in addition to the PIN and TAN. The data concerning your identity includes your first name and surname, address, phone number(s), email address, IP address, and any other data of relevance to the transaction. It is necessary to transfer this data in order to identify you unequivocally and prevent attempts at fraud.

1. – Applicability 


(1) The following General Terms and Conditions (“GTC”) apply on an exclusive basis to business relationships between FREITAG lab. AG (“we”) and buyers (“you”) as amended on the date the order is placed. We do not recognize any deviating terms and conditions you might have.

 

(2) We are entitled to modify, amend or delete the GTC at any time.

 

2. – Offers and conclusion of contract


(1) By placing an order for products and clicking on “Buy now”, you are submitting a binding offer to enter into a contract which we accept by sending the products, without providing any further confirmation.

 

(2) The scope and execution of the delivery are dependent on the conditions you have entered and selected. The contract comes into existence under the conditions set out in the offer (i.e. price and shipping costs).

 

(3) The order quantity is limited to a maximum of five articles at any one time. We reserve the right to decline and/or unilaterally cancel orders that exceed this amount. You will be informed of this separately.

 

(4) You are purchasing the products for personal use. You are forbidden from re-selling the purchased products for commercial purposes. 3. – Product colors 

 

(1) We endeavor to display the colors of the products as accurately as possible. Please note that there can be minor differences between the colors on the prints and the actual hues. Minor color differences are mostly due to monitor color display settings and are not defects. (2) Furthermore, please note that as the products we sell are made from recycled materials, there might be irregularities in terms of material properties and colors.

 

4. – Prices and payment 

 

(1) The prices are shown in Swiss francs, euros, pounds sterling, US dollars, Japanese yen, South Korean won, or Singapore dollars. The currency of an order depends on the country to which the order is to be delivered.

 

(2) Orders which are shipped to a country in the EU are billed in euros. Orders which are shipped to Switzerland or Liechtenstein are billed in Swiss francs. Orders which are shipped to the USA are billed in US dollars. Orders which are shipped to Great Britain are billed in pounds sterling. Orders which are shipped to Japan are billed in yen. Orders which are shipped to South Korea are billed in won. Orders which are shipped to Singapore are billed in Singapore dollars. Orders which are shipped to any other country than the expressly listed countries and unions of countries are billed in Swiss francs. FREITAG charges any applicable VAT and displays it in your basket.

 

(3) Shipments are only delivered once payment has been made using the accepted payment methods Visa, MasterCard, American Express, JCB, Sofort (EUR), and PayPal. European and Swiss customers can also pay in advance. Additionally, Swiss customers can opt to pay with PostFinance.

 

(4) If the delivery address is outside one of the countries or unions of countries listed in point (2), any import duties or VAT imposed by the country will be charged to you.

 

5. – Delivery terms and deadlines

 

The following delivery times apply without obligation for the regions listed below (working days: Monday to Friday):

 

Switzerland: 2–4 working days
Europe: 5–8 working days
Japan, Singapore, South Korea & USA: 4–6 working days
All other countries: 12–17 working days

 

Delivery price

The delivery price depends on the country of delivery as well as your basket and is shown in the second stage (“Delivery”) of the checkout process.

 

Imports, taxes, and customs duties

Deliveries to the EU, UK, USA, South Korea, Japan, Singapore: No other charges apply. All import taxes and customs duties are already included in the purchase price. Deliveries to a country that is not mentioned above are subject to customs, VAT and import taxes. These fees must be paid by the recipient when accepting the delivery.

6. – Right to cancel


(1) As a consumer, you are entitled to cancel this contract without providing a reason within 30 days of receiving the goods in accordance with the provisions of this section. If you wish to exercise your right to cancel, you must notify us (FREITAG lab. AG, Binzmühlestrasse 170b, 8050 Zurich, Switzerland; tel.: +41 43 210 33 33; email: onlinestore@freitag.ch) of your decision to cancel the contract by sending us an unequivocal statement (e.g. a letter, fax or email). You can use the attached cancellation form template but are under no obligation to do so. You need only send your notice of cancellation before the expiry of the cancellation period in order to meet the cancellation deadline.

 

(2) If you cancel this contract, we are obliged to refund all payments received from you, including delivery costs (excluding the additional costs resulting from your selection of different delivery method other than the cheapest standard delivery option offered by us), immediately or within 14 days of our receipt of your notice of cancellation at the latest. For this reimbursement, we use the same payment method that you used for the original transaction unless we expressly agree otherwise with you; under no circumstances will you be charged for this refund. We can refuse to refund your payment until we receive the goods or until you provide evidence that you have sent the goods back, whichever happens first. Customers in Germany can return goods to our branch in Hamburg. If you opted to pay in advance for your order, please enclose your bank details.

 

(3) We inspect all goods returned in this way. You must pay the postage costs of returns. You must pay compensation for any loss of value suffered by the goods if the loss of value resulted from handling that was not necessary in order to inspect their quality, properties, and functionality. In particular, we can reduce the refund we owe if:
- traces of use are evident;
- the product was damaged while being shipped back to us.

7. – Right to exchange goods and returns

 

(1) If the product has defects of quality or if you did not order it, FREITAG will be happy to take back the product and refund the purchase price, the postage costs of the return, the customs duties and taxes (receipts required), and the original shipping costs, your right to cancel and your warranty claims notwithstanding. In this case, however, we will not take back the products if they bear traces of use such as
- traces resulting from normal use
- force majeure such as natural disasters
- traces of improper use
- interference by the buyer or a third party
- extreme use or manipulation by the customer

 

(2) No costs are refunded if the product goes missing while being shipped back to us. We recommend that you send the product with a provider that offers a tracking service.

 

8. – Our right


We are entitled to withdraw from the contract – including any outstanding part of the delivery or service – if you have provided false information about your creditworthiness.

 

9. – Retention of title 


The delivered goods remain our property until the purchase price and all related costs have been paid in full.

 

10. – Liability 


(1) You have statutory rights in the event that the goods are defective. You are free to demand a replacement, withdraw from the contract, or have the purchase price reduced.

 

(2) The warranty period is 24 months from the date of delivery. This period is a limitation period and also applies to claims to compensation for consequential damage caused by defects, provided that no claims for unauthorized handling are filed.

 

(3) Compensation claims are excluded. This excludes compensation claims resulting from an injury to life, limb, or health, as well as liability for other damage caused by an intentional or grossly negligent breach of duty by us, our legal representatives, or our vicarious agents. Furthermore, this does not affect liability for breaches of duties which must be fulfilled in order that the contract can be duly executed and on the fulfillment of which the customer can normally rely. In the case of a slightly negligent breach of these contractual duties, we can only be held liable for the typical foreseeable damage unless the claims are compensation claims resulting from an injury to life, limb, or health. This also applies in favor of our legal representatives and vicarious agents if claims are filed against them directly. This does not affect the provisions of the Swiss Product Liability Act (Produktehaftpflichtgesetz).

 

11. – Data security 


(1) Data is encrypted with proven SSL technology. Every transaction is authorized and verified online by the credit card company. Blocked or counterfeit credit cards cannot be used. We undertake not to sell or disclose customer data to third parties. An exception to this is the transfer of customer data for logistical reasons (to delivery partners).

 

12. – Protection of intellectual property 


Our trademarks, business designations, designs, products, and website content are protected by copyright. Modifications, reproductions, and imitations of any kind are prohibited.

 

13. – Final provisions 


(1) For customers in Switzerland: These GTC and the contracts concluded on the basis of these GTC are subject to Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Zurich.

 

(2) For all other customers: All transactions are subject to Swiss law. The place of jurisdiction is Zurich. However, if you are a consumer, this only applies in so far as the protection is not withdrawn by mandatory provisions of the law of the country in which you are habitually resident. The provisions of the UN Convention on Contracts for the International Sale of Goods expressly do not apply.

 

(3) If any provision of these General Terms and Conditions should be ineffective, either fully or partially, this does not affect the validity of the remaining provisions. The fully or partially ineffective provisions will be replaced by provisions which best approximate the purpose of the ineffective provisions.
