We herewith object to the use of contact information published in conjunction with the mandatory information to be provided in section “Information Required by Law” to send us promotional and information material that we have not expressly requested. The processing of these data is based on Art. 6 para. 1 lit. b GDPR, if your request is related to the execution of a contract or if it is necessary to carry out pre-contractual measures. In all other cases, the processing is based on your consent (Article 6 (1) a GDPR) and/or on our legitimate interests (Article 6 (1) (f) GDPR), since we have a legitimate interest in the effective processing of requests addressed to us.

The data sent by you to us via contact requests remain with us until you request us to delete, revoke your consent to the storage or the purpose for the data storage lapses (e.g. after completion of your request). Mandatory statutory provisions - in particular statutory retention periods - remain unaffected.

This website uses functions of the web analysis service Google Analytics. The provider of this service is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics uses so-called cookies. Cookies are text files, which are stored on your computer and that enable an analysis of the use of the website by users. The information generated by cookies on your use of this website is usually transferred to a Google server in the United States, where it is stored.

The storage of Google Analytics cookies and the utilization of this analysis tool are based on Art. 6 Sect. 1 lit. f GDPR. IP ANONYMIZATION

On this website, we have activated the IP anonymization function. We shall use such data only for the sending of the requested information and shall not share such data with any third parties.

MAILCHIMP

This website uses the services of MailChimp to send out its newsletters. The provider is the Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.

Among other things, MailChimp is a service that can be deployed to organise and analyse the sending of newsletters. Whenever you enter data for the purpose of subscribing to a newsletter (e.g. your e-mail address), the information is stored on MailChimp servers in the United States.

MailChimp is in possession of a certification that is in compliance with the “EU-US-Privacy-Shield.” The “Privacy-Shield” is a compact between the European Union (EU) and the United States of America (USA) that aims to warrant the compliance with European data protection standards in the United States.

With the assistance of the MailChimp tool, we can analyse the performance of our newsletter campaigns. If you open an e-mail that has been sent through the MailChimp tool, a file that has been integrated into the e-mail (a so-called web-beacon) connects to MailChimp’s servers in the United States. As a result, it can be determined whether a newsletter message has been opened and which links the recipient possibly clicked on. Technical information is also recorded at that time (e.g. the time of access, the IP address, type of browser and operating system). This information cannot be allocated to the respective newsletter recipient. Their sole purpose is the performance of statistical analyses of newsletter campaigns. The results of such analyses can be used to tailor future newsletters to the interests of their recipients more effectively.

If you do not want to permit an analysis by MailChimp, you must unsubscribe from the newsletter. We provide a link for you to do this in every newsletter message. Moreover, you can also unsubscribe from the newsletter right on the website.

The data is processed based on your consent (Art. 6 Sect. 1 lit. a GDPR).  You may revoke any consent you have given at any time by unsubscribing from the newsletter. EXECUTION OF A CONTRACT DATA PROCESSING AGREEMENT

We have executed a so-called “Data Processing Agreement” with MailChimp, in which we mandate that MailChimp undertakes to protect the data of our customers and to refrain from sharing it with third parties.

6. PLUG-INS AND TOOLS

YOUTUBE WITH EXPANDED DATA PROTECTION INTEGRATION

Our website uses plug-ins of the YouTube platform, which is being operated by Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in the expanded data protection mode. According to YouTube, this mode ensures that YouTube does not store any information about visitors to this website before they watch the video. Nevertheless, this does not necessarily mean that the sharing of data with YouTube partners can be ruled out as a result of the expanded data protection mode. For instance, regardless of whether you are watching a video, YouTube will always establish a connection with the Google DoubleClick network.

As soon as you start to play a YouTube video on our website, a connection to YouTube’s servers will be established. As a result, the YouTube server will be notified, which of our pages you have visited. If you are logged into your YouTube account while you visit our site, you enable YouTube to directly allocate your browsing patterns to your personal profile. You have the option to prevent this by logging out of your YouTube account.

Furthermore, after you have started to play a video, YouTube will be able to place various cookies on your device. PAYPAL

Among other options, we offer payment via PayPal on our website. The provider of this payment processing service is PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter referred to as “PayPal”).

If you choose payment via PayPal, we will share the payment information you enter with PayPal.

The legal basis for the sharing of your data with PayPal is Art. 6 Sect. 1 lit. a GDPR (consent) as well as Art. 6 Sect. 1 lit. b GDPR (processing for the fulfilment of a contract). You have the option to at any time revoke your consent to the processing of your data. Such a revocation shall not have any impact on the effectiveness of data processing transactions that occurred in the past.

INSTANT TRANSFER SOFORT

Among other options, we offer the payment service called “instant transfer Sofort” on our website. The provider of this payment option is the Sofort GmbH, Theresienhöhe 12, 80339 München, Germany (hereinafter referred to as “Sofort GmbH”).

With the assistance of the “instant transfer Sofort” tool, we receive a payment confirmation from the Sofort GmbH in real time, which allows us to instantly start to fulfil our obligations to you.

When you choose the “instant transfer Sofort” payment option, you must send a PIN and a valid TAN to the Sofort GmbH, which allows the company to log into your online banking account. Upon logging in, the Sofort GmbH will verify your account balance and will execute the bank transfer to us with the assistance of the TAN you provided. Subsequently, the company sends us an immediate transaction confirmation. After Sofort GmbH has logged in, the system will also automatically verify your revenues and check the credit limit of your pre-approved overdraft credit line and the existence of other accounts along with their balances.

Along with the PIN and TAN numbers, the system also transfers the payment information you entered along with personal data to the Sofort GmbH. Your personal data comprise your first and last name, address, phone number(s), e-mail address, IP address as well as any other data required for the processing of the payment transaction. This data must be transferred in order to be able to determine your identity with absolute certainty and to prevent attempts to commit fraud.

FREITAG Online Shop - Condizioni generali di vendita

§ 1 – Validità 
(1) Nelle relazioni commerciali tra la FREITAG lab. AG (qui di seguito denominate «noi») e il committente (qui di seguito «Lei») valgono esclusivamente le seguenti condizioni generali di vendita nella versione vigente al momento dell’ordinazione. Non sono riconosciute condizioni diverse poste da parte Sua.

(2) Abbiamo facoltà di integrare, modificare o cancellare in qualunque momento queste condizioni.

§ 2 – Offerta e conclusione del contratto
(1) Con l’ordinazione della merce desiderata e l’azionamento del bottone «Comprare» Lei conferisce un ordine vincolante ai fini della conclusione di un contratto, che noi accettiamo senza ulteriori conferme inviandole la merce.

(2) L’esecuzione e il contenuto della fornitura si basano sulle condizioni da Lei scelte e indicate. Il contratto è stipulato alle condizioni valevoli di volta in volta per l’offerta specifica (prezzo, spese di spedizione).

(3) La quantità ordinabile è limitata a un massimo di 5 articoli. Ci riserviamo di non accettare le ordinazioni che superano questa quantità e/o di annullarle unilateralmente. Di ciò La informeremo separatamente.

(4) L’acquisto dei prodotti avviene per Suo uso personale. Non è consentito rivendere a scopo commerciale le merci acquistate. Ci riserviamo le opportune azioni legali e a tutela del nostro marchio. Se Lei desidera acquistare quantità maggiori o merci a scopo di rivendita commerciale, voglia prendere contatto con noi (wholesale@freitag.ch) per un’ordinazione separata. In mancanza di tale contatto o se in un breve periodo di tempo vengono svolte più ordinazioni in quantità elevate, ci riserviamo di annullare unilateralmente tali ordinazioni.

(5) La quantità ordinabile per le Limited Editions e Special Editions è limitata a un articolo per ciascun utente. Ci riserviamo di non accettare le ordinazioni che superano questa quantità e/o di annullarle unilateralmente. Di ciò La informeremo separatamente.

(6) Ogni cliente può effettuare un numero massimo di 1 ordinazioni con pagamento anticipato nel periodo in cui quest’ultime si trovano ancora in fase di elaborazione. Ci riserviamo il diritto di non accettare e/o di stornare unilateralmente le ordinazioni pervenute che superano il suddetto limite. Verrà informato al riguardo separatamente.

§ 3 – Colori dei prodotti 
(1) Ci sforziamo di rappresentare i colori dei prodotti in modo veritiero. Precisiamo che possono esservi minime differenze tra i colori che compaiono in fotografia e le sfumature cromatiche reali. Leggere differenze di colore sono dovute nella maggior parte dei casi alle impostazioni dei colori del video e non costituiscono un difetto della merce.

(2) Precisiamo inoltre che i prodotti da noi distribuiti sono fabbricati con materiali riciclati e pertanto possono presentare delle irregolarità nelle caratteristiche del materiale e del colore.

§ 4 – Prezzi e pagamento 
(1) I prezzi sono indicati in franchi svizzeri, euro, sterlina inglese, dollari USA, yen giapponesi, won coreani o dollari da Singapore. La valuta di un ordine dipende dal paese di destinazione di un ordine.

(2) Gli ordini consegnati in Svizzera o nel Liechtenstein sono fatturati in franchi svizzeri. Gli ordini consegnati negli USA sono fatturati in dollari USA. Gli ordini consegnati in Giappone sono fatturati in yen giapponesi. Gli ordini consegnati nella Corea del sud sono fatturati in won sudcoreani. Gli ordini consegnati a Singapore sono fatturati in dollaro di Singapore. Gli ordini per paesi diversi dagli stati e dalle federazioni di stati esplicitamente elencati, sono fatturati in franchi svizzeri.

(3) Le forniture avvengono esclusivamente dietro pagamento con un mezzo accettato: Visa, Mastercard, American Express, JCB, SOFORT (EUR) e Paypal. I clienti dell’UE e svizzeri possono pagare anche anticipatamente. I clienti svizzeri, inoltre, possono pagare anche con la Postcard.

(4) Se l'indirizzo di consegna è al di fuori degli stati o delle federazioni di stati citati al punto (2), saranno fatturati a suo carico i dazi d'importazione merci e l'IVA dei rispettivi stati.

§ 5 – Termini e condizioni di fornitura
Per le Regioni sotto elencate si calcolino approssimativamente i seguenti tempi di consegna (giorni feriali, dal lunedì al venerdì):

Svizzera: 2-4 giorni
Europa: 5-8 giorni
Giappone, Corea del Sud, Singaporo, Stati Uniti, Canada: 4-6 giorni
Resto del mondo: 12-17 giorni

Spese di spedizione
Le spese di spedizione vengono calcolate nel carrello.

Costi aggiuntivi
Consegna nei paesi dell'UE, negli USA, in Corea del Sud, Giappone, a Singapore:
Non vi sono ulteriori costi. L'IVA è già compresa nel prezzo di vendita.

Per consegne in Stati non elencati sopra dovranno essere calcolate tasse d'importazione, IVA e spese doganali. Queste dovranno essere pagate al ricevimento della merce.

§ 6 – Diritto di sostituzione e restituzione della merce
(1) È possibile restituire la merce per qualsiasi ragione entro 30 giorni dalla data di spedizione. Le spese di spedizione non sono rimborsabili.

(2) Effettueremo controlli su tutti i prodotti restituiti. Tutta la merce deve essere restituita in perfette condizioni e non deve mostrare segni d'uso. Per questo tipo di restituzione le spese postali sono a vostro carico. Non accetteremo la restituzione del prodotto se:
- Il prodotto mostra segni visibili d'uso
- Il prodotto è danneggiato a causa del trasporto per la restituzione

Sarete rimborsati del vostro pagamento (dazi, tasse e altre spese escluse). In caso di restituzione tutte le spese di spedizione saranno a vostro carico. I clienti in Germania possono inviare il reso alla nostra filiale di Amburgo.
La restituzione dell'importo d'acquisto avviene con la stessa modalità del pagamento effettuato dal cliente. Qualora avesse pagato anticipatamente, la preghiamo di comunicarci i suoi dati bancari insieme al reso.

(3) Se il prodotto risulta difettoso o non corrisponde al prodotto ordinato, saremo lieti di rimborsarvi il prezzo di acquisto, i costi di spedizione per la restituzione, le tasse, le imposte e i dazi (dietro prova di pagamento, ovvero ricevuta), oltre ai costi di spedizione iniziali. Non potranno essere restituiti i prodotti che mostrano segni di danno o manomissione, come per esempio:
- Segni lasciati dalla normale usura
- Eventi di forza maggiore, per es. disastri naturali
- Segni di uso improprio
- Manomissione da parte del cliente o di terzi
- Uso estremo o sollecitazione estrema da parte del cliente

(4) Se il prodotto (o i prodotti) viene perso durante il trasporto di restituzione, i costi non saranno rimborsati. Vi consigliamo di rispedire tutti gli articoli servendovi di un'azienda di trasporto che fornisce un servizio di tracciamento della spedizione (track & trace service).

§ 7 – Nostri diritti
Abbiamo facoltà di recedere dal contratto anche per una parte ancora da eseguire della fornitura o della prestazione, qualora siano state fatte dichiarazioni errate circa il Suo merito creditizio.

§ 8 – Riserva di proprietà 
Sino al completo pagamento del prezzo d’acquisto e delle relative spese, la merce consegnata resta di nostra proprietà.

§ 9 – Responsabilità
(1) In caso di vizio non irrilevante della merce Lei ha i diritti di garanzia previsti dalla legge. Lei può scegliere se richiedere un prodotto sostitutivo, recedere dal contratto o ridurre in accordo con noi il prezzo d’acquisto.

(2) Per quanto fattibile secondo il normale svolgimento dell’operazione, Lei è tenuto a verificare le proprietà della cosa ricevuta e, qualora essa presentasse vizi coperti dalla nostra garanzia, a segnalarceli immediatamente. In caso contrario può perdere i Suoi diritti citati al punto 9 (1).

(3) Salvo diversa disposizione qui di seguito, sono escluse ulteriori rivendicazioni del committente, per qualunque ragione giuridica. Non rispondiamo dei danni che non interessano l’oggetto stesso della fornitura, in particolare di mancato introito o di altri danni patrimoniali del committente. L’esclusione della responsabilità vale anche per la responsabilità personale dei collaboratori, rappresentanti e ausiliari. Tale limitazione non si applica nei casi di dolo o negligenza grave, in presenza di un danno alle persone o in caso di applicazione la legge sulla responsabilità per danno da prodotti. Il termine di garanzia è di 12 mesi a decorrere dalla data della fornitura, da considerarsi come termine di prescrizione valevole anche per le richieste di risarcimento di danni indiretti, salvo la possibilità di rivendicazioni per atto illecito.

(4) Per altre violazioni dei nostri obblighi rispondiamo solo in caso di dolo o negligenza grave. Questa limitazione vale anche per rappresentanti legali, prestatori d’opera, impiegati, collaboratori e ausiliari.

§ 10 – Sicurezza dei dati 
(1) I dati sono codificati con la sperimentata tecnologia SSL. Ogni transazione è autorizzata e verificata online dalla rispettiva società emittente della carta di credito. Non possono essere utilizzate carte di credito bloccate o false. Ci impegniamo a non vendere o cedere a terzi alcun dato dei nostri clienti. Fa eccezione la comunicazione dei dati per ragioni logistiche (imprese di trasporto).

§ 11 – Protezione della proprietà industriale
I nostri marchi, denominazioni commerciali, design, prodotti e contenuti del sito Internet sono soggetti a protezione della proprietà industriale. Sono vietate modificazioni, riproduzioni e imitazioni di ogni tipo.

§ 13 – Disposizioni finali 
(1) Per clienti in territorio svizzero: sulle presenti condizioni generali di vendita e sui contratti conclusi in base a esse prevale il diritto svizzero. E’ esclusa la Convenzione delle Nazioni Unite sui contratti di compravendita internazionale di merci (CISG). Foro competente è Zurigo.

(2) Per tutti gli altri clienti: su tutte le operazioni prevale il diritto svizzero. Foro competente è Zurigo. Per Lei, in quanto consumatore, ciò vale solo nella misura in cui non intacca la protezione garantita dalle disposizioni di legge cogenti dello Stato dove Lei ha la Sua dimora abituale. E’ espressamente esclusa l’applicazione della Convenzione delle Nazioni Unite sui contratti di compravendita internazionale di merci (CISG).

(3) Qualora singole disposizioni di queste condizioni generali fossero del tutto o parzialmente inefficaci, ciò non pregiudica la validità delle restanti disposizioni. Le clausole totalmente o parzialmente inefficaci saranno sostituite da disposizioni che si avvicinino quanto più possibile al contenuto di quelle divenute inefficaci.
